How to Process a Change of Name by Deed Poll in Malawi

A Deed Poll is a legal document used by a person to officially change their name. In Malawi, the process is carried out under the Registration of Documents Act and makes the new name legally recognised by government offices, banks, schools and other institutions.

Applicants need an original birth certificate or age assessment, a National ID, a sworn affidavit explaining the reason for the change, passport photos and supporting documents such as academic or employment records.

The process starts by hiring a licensed legal practitioner or Commissioner for Oaths to prepare the Deed Poll. The applicant then signs it using both the old and new names in the presence of the Commissioner and two adult witnesses. The document is registered with the Registrar General’s Department after paying the required fees.

The registered Deed Poll must then be published in the Malawi Government Gazette. After publication, the applicant can use the documents to update their National ID, passport, bank accounts, TPIN and academic records.

The process involves legal and government fees. Registration normally takes 3–7 working days, while Gazette publication can take 2–4 weeks. Once registered and gazetted, the name change becomes a permanent legal record.
